Please read these Terms of Service carefully before booking a safari or travel package with Kenya Apex Safaris ("we", "our", "us"). By making a booking, you agree to be bound by these terms on behalf of yourself and all members of your travel party.

1. Booking & Confirmation

A booking is confirmed when we receive your completed booking enquiry and a deposit payment. We will then issue a written booking confirmation. The deposit amount is specified at the time of booking and varies by package. Receipt of a deposit does not guarantee availability until confirmed in writing by Kenya Apex Safaris.

2. Payment Terms

  • Deposit: A non-refundable deposit of 30% of the total package price is required to secure your booking.
  • Balance payment: The remaining balance is due no later than 45 days before your safari departure date.
  • Late bookings: For bookings made within 45 days of departure, full payment is required at the time of booking.
  • All prices are quoted in USD unless otherwise stated. Local packages (Diani, Naivasha) are quoted in KES.

3. Cancellation Policy — By Client

If you need to cancel your booking, cancellation must be made in writing to our office. The following cancellation charges apply based on the number of days before the departure date:

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, as we cannot be held liable for losses arising from your cancellation.

4. Cancellation by Kenya Apex Safaris

We reserve the right to cancel a safari or package in the following circumstances:

  • Insufficient participant numbers (for group departures)
  • Force majeure events — natural disasters, political instability, government travel advisories, pandemics, or other circumstances beyond our control
  • Non-payment by the client by the due date

If we cancel your safari (excluding force majeure), we will offer you an alternative date or a full refund of all payments made. In force majeure situations, we will offer a credit for future use or a refund less any non-recoverable costs.

5. Changes to Bookings

Any changes to confirmed bookings (dates, package type, group size) must be made in writing. Changes are subject to availability and may incur an administration fee. Changes made within 30 days of departure are treated as cancellations and rebookings.

6. Prices & Inclusions

  • All prices are per person unless otherwise stated.
  • Prices are valid for the stated season and are subject to change without notice for future dates.
  • Quoted prices include items specified in the "Safari Includes" section of each package.
  • Items listed under "Excludes" are the client's responsibility.
  • Kenya Apex Safaris reserves the right to pass on any government-imposed tax increases or park fee increases that occur after booking confirmation.

7. Travel Documents & Visas

It is the client's sole responsibility to ensure they hold a valid passport (valid for at least 6 months beyond the return date), appropriate visas, and any required vaccinations. Kenya Apex Safaris provides general guidance but cannot be held responsible for any client's failure to obtain correct travel documents. Most nationalities require a visa to enter Kenya — this can be obtained online at evisa.go.ke.

8. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance before travel. This should cover medical emergencies, emergency evacuation, trip cancellation, lost baggage, and personal liability. Safari activities involve inherent risks in remote environments, and adequate insurance is essential.

9. Health & Safety

By booking a safari, you confirm that all members of your party are in good health and physically capable of participating in the activities described. Kenya Apex Safaris reserves the right to exclude any client from activities if our guides consider it unsafe to proceed. Our guides' safety decisions are final.

Wildlife safaris involve encounters with wild animals. Clients must follow all guide instructions at all times. Kenya Apex Safaris accepts no liability for injury or loss resulting from failure to follow guide instructions.

10. Liability

Kenya Apex Safaris acts as an agent for accommodation providers, transport operators, and other service providers. While we take every care in selecting our partners, we cannot be held liable for:

  • Acts or omissions of third-party service providers
  • Events outside our control including force majeure
  • Personal injury, loss of property, or damage suffered during your safari
  • Changes to park conditions, wildlife availability, or weather

11. Complaints

If you have a complaint during your safari, please inform your guide immediately so we can attempt to resolve the issue. Any unresolved complaints must be submitted in writing within 14 days of your return. We will acknowledge receipt within 5 business days and aim to resolve within 28 days.

12. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
